TERMS OF USE (Sales and Service Terms)

1. General Provisions

1.1. These terms regulate the legal relationship arising between the user of the website www.ortopro.ee (hereinafter the Website) (hereinafter the Client) and Ortopro OÜ (registry code 14390737, located at J. Sütiste tee 19a, Tallinn, hereinafter the Service Provider).

1.2. These terms regulate the ordering, purchase, and provision of prostheses, orthoses, other medical devices, and related services.

1.3. The Service Provider reserves the right to amend the terms of use. Changes will be reflected on the Website.

2. Services and products

2.1. The Service Provider offers the manufacturing, customization, and sale of limb prostheses, orthoses, and other orthopedic aids.

2.2. Most products are individually customized or manufactured based on the Client's personal needs (measurements, diagnosis).

2.3. The exact nature, price, and lead time for products and services are agreed upon with the Client during an individual consultation.

3. Prices and State Subsidies

3.1. All prices on the Website are in euros and include the value-added tax applicable in the Republic of Estonia (standard or reduced rate as per law).

3.2. When purchasing limb prostheses and orthoses, it is often possible to apply for state subsidies (Health Insurance Fund, Social Insurance Board). The Service Provider will assist with the application process if necessary, but the final approval of the subsidy depends on the decisions of state institutions and the Client's eligibility.

3.3. The Client is responsible for the co-payment portion of the product, which must be paid according to the invoice provided or on-site.

4. Right of Withdrawal and Returns

4.1. In accordance with the Law of Obligations Act, the Client has the right to withdraw from a contract concluded via an online store or means of distance communication within 14 days.

4.2. Exception: The right of withdrawal does not apply to products manufactured or customized according to the Client's personal needs and measurements (e.g., custom limb prostheses, specialized orthoses). Such products cannot be returned.

4.3. For the return of standard products, the item must be unused, in its original packaging, and in its original condition. The Client bears the costs associated with the return, unless the return is due to a defective or incorrect product.

5. Claims and Warranty

5.1. The Service Provider is responsible for the conformity of products and services and for any defects that appear within 2 years after the product has been delivered to the Client. It is presumed that any defect appearing within the first year was already present at the time of delivery.

5.2. The warranty and the right to file a claim do not apply to consumables (e.g., silicone liners) to the extent of normal wear and tear, nor to damage resulting from improper use or maintenance of the product by the Client.

5.3. In the event of a defect, please stop using the product immediately and contact us via email at ortopro01@gmail.com.

6. Force Majeure

6.1. The service provider is not liable for damages caused to the Client or for delays in the product/service if these are due to circumstances that could not have been foreseen or influenced (force majeure).

7. Dispute resolution

7.1. If the Client has any complaints, they should be sent to the email address ortopro01@gmail.com or by calling +372 514 6872.

7.2. If disputes cannot be resolved through negotiation, the Client has the right to contact the Consumer Disputes Committee operating under the Consumer Protection and Technical Regulatory Authority.

PRIVACY POLICY

1. General provisions and the data controller

1.1. This privacy policy explains how Ortopro OÜ (registry code 14390737, hereinafter the Data Controller) collects, uses, and protects personal data on the website www.ortopro.ee and during the provision of services.

2. What data do we collect? As we provide medical aids (prosthetics, orthotics), we collect special categories of personal data (health data) in addition to standard contact information when necessary. The data collected includes:

2.1. Contact and personal data: First and last name, personal identification code, phone number, email address, postal address.

2.2. Health data: Diagnoses, referrals, medical certificates, physical measurements, and parameters that are strictly necessary for the manufacture and fitting of a suitable prosthetic or orthotic device.

2.3. Financial data: Bank account number (if refunds are issued) and payment information.

2.4. Device and usage data: IP address, time of website visit, browser and device used.

3. Purpose and legal basis for the processing of personal data

3.1. Contractual relationship and service provision: Data (including measurements) is processed to fulfill the Client's order and for the manufacture and maintenance of prosthetics. Legal basis: performance of a contract.

3.2. Processing of health data: We process health data solely for the safe and proper provision of services (e.g., selecting the correct prosthetic technology) with the Client's prior consent or as required by legal obligations related to the organization of healthcare services. Legal basis: consent and/or protection of vital interests, provision of healthcare services.

3.3. Legal obligation: Data is transferred to the Health Insurance Fund and the Social Insurance Board and processed for accounting purposes in accordance with Estonian law.

3.4. Client communication: Client contact details are used to confirm appointments, notify the client when a product is ready, and request feedback.

4. Who do we share data with?

4.1. The data controller keeps the client's personal data confidential.

4.2. Health and contact data may be transferred to government agencies (Health Insurance Fund, Social Insurance Board, Health Board) when necessary for processing and billing state subsidies.

4.3. Accounting data is transferred to the company's accounting service provider.

4.4. Data is not sold, rented, or transferred to third parties for marketing purposes.

5. Data retention

5.1. Client personal and health data are retained for as long as necessary to provide the service (e.g., warranty period, the lifespan of the device for support purposes) or in accordance with statutory deadlines.

5.2. Accounting source documents are retained for 7 years in accordance with the Accounting Act. Health data may be retained for a longer period as required by law (requirements for documenting healthcare services).

6. Client rights regarding personal data

The client has the right at any time to:

6.1. Receive information about the personal data collected about them and how it is processed.

6.2. Request the correction of inaccurate personal data.

6.3. Request the deletion of your data ("right to be forgotten"), unless we have a legal obligation to retain the data (e.g., for accounting purposes).

6.4. Restrict the processing of your data or withdraw previously given consent (including for the processing of health data). Please note that this may limit our ability to provide you with specific prosthetic services.

6.5. File a complaint with the Data Protection Inspectorate (www.aki.ee) if you believe your data has been processed unlawfully.
